Agreement to these terms

By using this website, contacting Distract Studio, booking a call, signing a proposal, or purchasing services, you agree to these Terms of Service. If a signed statement of work, proposal, or master services agreement applies to your project, that agreement controls where it conflicts with these website terms.

Services and project scope

Distract Studio provides strategy, branding, website design, Framer development, content, SEO foundations, and related creative services. The specific deliverables, timeline, fees, revision rounds, and launch responsibilities for any client project will be defined in the applicable proposal, invoice, statement of work, or written agreement.

Client responsibilities

Clients are responsible for providing accurate information, timely feedback, brand assets, content, access to required accounts, and approvals needed to complete the work. Delays in feedback, access, content, or approvals may affect timelines, launch dates, and project availability.

Payments, deposits, and expenses

Fees, deposits, payment schedules, and accepted payment methods are stated in the applicable proposal or invoice. Unless otherwise agreed in writing, deposits and scheduled payments reserve studio time and may be non-refundable. Third-party costs, subscriptions, fonts, stock assets, software, hosting, plugins, domains, advertising spend, or other outside expenses are the client’s responsibility unless expressly included.

Revisions, approvals, and changes

Included revision rounds are limited to the scope described in the project agreement. Requests that materially change the scope, direction, deliverables, timeline, functionality, or content volume may require a change order, additional fee, or revised schedule. Once work is approved, later changes may be treated as new work.

Intellectual property and portfolio use

Unless otherwise stated in writing, final client deliverables become the client’s property after all required payments are received. Distract Studio retains ownership of pre-existing tools, templates, processes, concepts not selected, working files, internal systems, and know-how. We may display completed work, project visuals, client names, testimonials, and results in our portfolio, marketing, social channels, case studies, and sales materials unless confidentiality terms say otherwise.

Website use, third-party tools, and no guarantees

You agree not to misuse this website, interfere with its operation, copy protected content, or use it for unlawful purposes. Our work may rely on third-party platforms such as Framer, analytics, scheduling, forms, payment processors, hosting, integrations, or plugins. We are not responsible for third-party outages, policy changes, pricing changes, or platform limitations. We do not guarantee specific revenue, traffic, ranking, conversion, approval, or business outcomes.
